This work reveals that the procedure for penalty orders arose out of a conflict of competence between the police and the judiciary. It established itself as part of procedural law and became an essential component of the Code of Criminal Procedure. The development of the procedure - from the early 19th century in Berlin with the mandate procedure in police law to the present day - is presented and evaluated.
